Should You File Bankruptcy Online?

What can go wrong if you file bankruptcy yourself? Is it a good idea to file bankruptcy online? You'll save if you file for bankruptcy by yourself but it's risky to file bankruptcy without a lawyer.



I am not an attorney. I am just a Florida resident who has been through a personal bankruptcy. I offer this information simply to aid you in making the difficult choices involved in filling bankruptcy in Florida.

Although Florida bankruptcy law allows residents to file bankruptcy without a lawyer, it may not be the best idea. After going through the process with a lawyer, I know it would not have been a good idea for me to file my own bankruptcy.

There was a lot of paperwork. Even working with a paralegal, I still had to fill out countless forms.

You can obtain Florida bankruptcy forms online or in some bookstores for $50 or less. For me, obtaining the forms was not the problem. Knowing how to fill them out properly is what would have tripped me up.

I have never worked in the legal field and this was the only time I had ever had any dealings with the court. Someone who has filed court documents before or has some legal training may feel more comfortable doing a self file bankruptcy.

File Bankruptcy Online

It would certainly be easier to file for bankruptcy online than to physically fill out all the forms and fax or hand carry all the required documents to the bankruptcy court.You will still have to type in answers to a lot of questions. The problem is, some of them may be written in legalese. If you have questions, only a licensed attorney can legally advise you.

If the forms are not filled out properly, your discharge could be denied or you could end up losing property that you might have kept.

So, should you file for bankruptcy by yourself?

If you have legal training and no assets to protect, you can probably file bankruptcy by yourself.

If you own a home or cars you wish to keep, I don't think you should file your own bankruptcy.

For instance, I might have lost my home--even though it is a Homestead property--but for 1 piece of information the paralegal who worked my case gave me.
